Sex with a Minor
Cases involving allegations of sex offenses with minors are among the most aggressively prosecuted cases in Arizona and usually carry significant prison sentences upon conviction. They typically arise from allegations of intercourse or oral sexual contact with a minor under the age of 18. In addition to the stiff mandatory penalties mandated by law, facing sex crime charges also means facing the stigma and embarrassment that are associated with these types of allegations.
With both your reputation and freedoms at risk, it is imperative that you contact an former prosecutor like Joshua Davidson and retain his experienced representation if you have been accused of sex conduct with a minor. The charges and penalties for sex conduct with a minor vary depending on a number of factors including the age of the child involved. For instance, if a person is convicted of sexual conduct with a minor under the age of 15, the offense is considered a Dangerous Crime Against Children (DCAC) and the judge is required to impose a prison term of 13 to 27 years. These lengthy prison terms must be served consecutively to all other sentences and do not allow early release credits to be earned with good behavior while incarcerated. Moreover, separate acts of sexual conduct with the same minor on the same occasion can all be charged in separate counts and result in the imposition of multiple consecutive sentences.
For most individuals convicted of sexual conduct with minors 12 years of age or under, the law requires even more severe mandatory minimum penalties – life in prison with no eligibility for release until 35 years are served. Charges involving minors who are 15 through 17 years of age are significantly less serious. Depending on the number of charges and whether any prior criminal record exists, the penalty may include probation and allow prison to be avoided altogether. Regardless of the alleged victim’s age, all convictions for sex conduct with a minor require registration with the sex offender registry.
