Arizona's 'Extreme DUI' Penalties

Under Arizona law, it’s illegal to drive while under the influence of alcohol or any drugs, or to be in “actual physical control” of a vehicle while under the influence of alcohol or drugs. Essentially, this means that you can’t be sitting behind the wheel of a vehicle with the car keys nearby while under the influence.

There are a number of factors that affect one’s ability to drive safety, even after one drink, such as gender, body fat, body weight, emotional state, or even physical health. For this reason, the Arizona Department of Transportation warns Arizona drivers not to drink and drive.

If you are pulled over on suspicion of DUI and a chemical test reveals that you have a blood alcohol concentration of .08% or above, or if such a test is unavailable, you’ll automatically lose your driving privileges.

The penalties for a first DUI in Arizona with a BAC that is under 0.15% include: at least 10 days in jail, a minimum fine of $1,250, community service, an Ignition Interlock Device, and you will be screened for alcohol education and treatment.

If your BAC registers at 0.15% or higher, the DUI is elevated to an “Extreme DUI,” which brings stiffer penalties.

Penalties for a High BAC (Extreme DUI)

If your BAC registered at 0.15% or above, you face the following penalties for a first offense:

  • You will be jailed for at least 30 days
  • You will not be eligible for probation
  • You will not be eligible for a suspended sentence
  • Your fine will be at least $2,500
  • You will undergo alcohol screening, education and treatment
  • You will have to perform community service
  • You must install an Ignition Interlock Device
