Arizona Drug DUIs and Their Consequences

When most people hear the term "DUI" they reflexively think of drinking and driving. But many DUI cases relate to the use of drugs, rather than alcohol, in combination with driving. There are basically two types of drug-DUIs. First, a person driving under the influence of drugs can be guilty of DUI – NOTE this can include even lawfully prescribed drugs. Second, in the case of illegal drugs, such as marijuana, cocaine, methamphetamine, or many other illegal drugs, a person is guilty of DUI merely by having some by-product of the drug present in their blood or urine at the time of the driving. NOTE for this offense that there is no requirement that the person be under the influence of the drug at the time of the driving. That is, someone who last smoked marijuana on Tuesday is automatically guilty of DUI for driving on Thursday or Friday.

In short, the DRUG – DUI law is very strict. The law also includes some enhanced punishment over and above the standard alcohol related DUI.
