Extreme DUI

In the state of Arizona, a DUI conviction can result in harsh penalties such as jail time, excessive fines, and probation. Depending upon the nature and extent of your DUI charge, you could lose your Phoenix driver’s license for months, years, and in some cases forever. You don’t have to face your DUI charges alone, and by hiring a qualified and experienced Phoenix DUI attorney you will have legal support that is vital to the success of your case.

Penalties for Extreme DUI in Arizona

If convicted of extreme DUI in Phoenix, Arizona, a driver may face the following penalties (these may vary depending upon the jurisdiction and the particular case, however):
  • Minimum 30-day consecutive jail sentence
  • Fines of no less than $250
  • Additional fines
  • Community service
  • Ignition interlock device
  • Drug or alcohol screening and treatment
  • Additional penalties will apply if the driver has a prior DUI conviction on his or her record

Because extreme DUI is a more serious criminal charge, the defendant will be given the option of a jury trial. Your attorney can discuss this with you in order to determine whether a jury trial will be beneficial to the outcome of your case. Under Arizona law, DUI can be prosecuted as the result of either having impaired driving ability or having a BAC of .08% or higher within two hours of driving.

If a blood alcohol level of .15% or higher is present within two hours of driving, the more serious offense of Extreme DUI will be charged. It used to be that a first Extreme DUI conviction in Phoenix could result in a 30 day jail sentence, but could be reduced down to 10 days if the defendant agreed to an alcohol/drug rehabilitation program. This law was recently changed and Arizona Extreme DUI conviction now includes a mandatory 30 day jail sentence, without the possibility of reduction for a first offense. Unlike with the previous law, there will now be no chance of getting time suspended. For a second Extreme DUI offense, you could be sentenced to 120 days in jail, with no chance of getting time suspended.

With this Extreme DUI law change, the penalties for a Phoenix Extreme DUI conviction are especially harsh. This is why you must fight to make sure that your rights are upheld throughout your DUI case in Arizona. Phoenix Extreme DUI Lawyer Joshua S. Davidson knows that your ability to provide for yourself and your family is very important to you. You need a competent and confident attorney who will be able to fight for your rights and help you maintain your freedom.

Super Extreme DUI

The “Super Extreme” DUI classification was recently created by Arizona lawmakers in an attempt to crack down on drunk drivers and decrease alcohol related fatalities in the state. Those arrested for DUI in Phoenix with a blood alcohol level of .20% are placed in the Super Extreme DUI charge category. The penalties for those charged with Super Extreme DUI include higher fines and a minimum jail sentence of 45 days. As a result of the laws surrounding Super Extreme DUI charges, you will be facing a significant amount of jail time and large fine amounts if convicted of Super Extreme DUI in Maricopa County.

If you can’t imagine how you could keep your job, your house and your financial stability if you had to pay fines in excess of $3,000 and spend at least a month and a half in jail, you need to do what you can to get the best defense possible. Phoenix Super Extreme DUI Lawyer Joshua S. Davidson has extensive experience successfully defending people who have been charged with this type of driving under the influence.

Phoenix Extreme DUI Attorney

By investigating the specific circumstances of your case and evaluating your extreme DUI charges, an experienced Phoenix DUI lawyer can make all the difference in the outcome of your case. This includes an evaluation of your field sobriety tests, breath test or blood test, police stop and the arrest itself. There may have been an error in the chemical test that was administered, and this could have led to a false reading that was too high. Your blood alcohol concentration will play a major role in whether you are charged with extreme DUI or face regular drunk driving charges. But with a skilled defense lawyer to contest your breath test or blood test results, you have a chance to avoid a conviction and serious penalties.

If you have been arrested for drunk driving in the State of Arizona, you can expect to be involved in two separate legal proceedings. The first criminal proceeding begins when you are arrested and can affect the overall outcome of your DUI case. The second is a civil proceeding which will be conducted with the Motor Vehicle Division (MVD) and determines whether or not your license will be suspended. Both proceedings are important to the outcome of your case, but do not necessarily affect one another. It is important that you have a Phoenix DUI lawyer by your side throughout the proceedings to protect your rights and handle your case in a way that will bring positive results.
