Amounts of Drugs Presumed for Sale: Defense Against Charges of Sales

In Arizona, pursuant to A.R.S §13-3407(A)(2) and A.R.S §13-3407(A)(7) it is unlawful for anyone to knowingly possess a dangerous drug for sale, or to transport a dangerous drug for sale. Transportation and intent to sell can be proven by a wide variety of factory including the weight of the drugs, how they are packaged and by whether or not the drugs are found in a moving vehicle.

If you possess lesser amounts of these drugs, it can also be established that they were for sale if you have other indicia of the intent to sell them, such as their individual packaging, a scale, and other forms of selling paraphernalia. Many transportation of drugs charges can carry a mandatory prison term depending on either the type of drug involved or weight of those drugs.

For example, if you possess over 9 grams of cocaine, 2 pounds of marijuana, 50 doses of LSD, three quarters of a gram of crack, one gram of heroin, or four grams of PCP, it is statutorily required that the judge order a prison term – even for a first offense. For other offenses, the penalties can range from probation to many years in prison, from a misdemeanor to a felony, depending on the amount of drugs involved, and of course includes costly mandatory fines as well.
