Repeat DUI Offenders in Arizona

Like other states, it’s against the law in Arizona to drive with a blood alcohol content (BAC) of .08% or above if you are 21 or older. For commercial drivers, the limit is .04% and for drivers under 21, the threshold is set at 0.00%. If you are pulled over on suspicion of driving under the influence (DUI), you will be asked to take a chemical test. If you refuse to take this test, your driver’s license will be automatically suspended for a first refusal. In Arizona, the penalties for DUI increase with each offense.   • 24 hours to 10 days in jail
  • A base fine of $250
  • 90 to 360-day license suspension
  • Ignition Interlock Device
Second DUI Offense
  • 30 to 90 days in jail
  • A base fine of $500
  • One year license suspension
  • Ignition Interlock Device
Third DUI Offense
  • Minimum of four months in jail
  • A base fine of $750
  • One year license suspension
  • Ignition Interlock Device
According to the Arizona Department of Public Safety, “Not many repeat [DUI] offenders are deterred by broad impaired driving laws. Four alternative sanctioning approaches have proven especially effective at reducing repeat offenses,” including:
  • Impoundment of the offender’s vehicle.
  • Ignition Interlock Device (IID) requirement.
  • Having the offender go on electronically monitored house arrest.
  • Having the offender go on intensive probation supervision. Meanwhile, the offender receives treatment, which addresses the repeat offender’s driving habits. This also includes intensive monitoring and counseling.
