There are essentially two different types of defenses to DUI cases; both of which require a practitioner who is knowledgeable and skilled in this very complex area of law to be able to fully take advantage of them. The first major group of defenses has to do with the testing equipment used by the police when they arrested you, whether it’s the breath testing machine that you have been required to blow in or the gas chromatograph that they ran your blood sample through if they ended up taking your blood. The skilled DUI attorney knows how to evaluate the maintenance records for these machines and identify any problems that they may have been experiencing at the time that you were arrested.
The other major area of defenses to a DUI case has to do with the conduct of the police during the course of the investigation. Did they have reasonable suspicion to pull your car over in the first place? Was there probable cause to arrest you? If you requested an attorney was that request honored, as the police are required to? These are all things that need to be looked at by a DUI defense attorney who’s knowledgeable in this very complex area of law.
